1. moneth of January last was a twelve moneth the állegate Thomas
2. Cox (who went hence in the shipp the Sampson allegate) did at the
3. Barbada's voluntarily forsake her and desert his service in her and
4. went away from her against the good will and liking of John Norbrooke
5. her master, and never retourned to his service in her againe, and
6. saith the said Norbrooke was thereby necessitated to hire another man
7. in the place and stead of the said Cox, all which hee knoweth because
8. hee this deponent was masters mate of the said shipp Sampson
9. and saw such was acquainted and tooke notice of such going away
10. and never retoruning of the said Cox, but was told by the lieutenant
11. of the Marston Moore frigot that the said Cox upon deserting the said
12. shipp sampson, came aboard the said frigot and presented his
13. service to the Captainee thereof and was intertained, And otherwise
14. hee cannot depose.

17. To the first hee favoureth the parties indifferently in respect
18. of the trueth, and accordingly would give the victory, and otherwise
19. negatively saving as aforesaid.
20. To the second hee saith that the said Cox the said voyage before such
21. his going away, did (for ought this deponent observed to the contrary)
22. behave himselfe well and performed his place and duty in the said
23. shipp, And otherwise hee cannot answer:
24. To the third hee saith that the next day after the said Cox had bin
25. and proffered his sevice to the Captaine of the Marston Moore as
26. aforesaid, the said Lieutenant came aboard ˹the Sampson˺ and demanded him and
27. tooke away him away and his clothes, and then declared that the said
28. Cox had bin aboard the said frigot the say before and proffered his
29. service as aforesaid, and that otherwise hee would not come fetch
30. him, for as hee said they pressed none, nor received any but what
31. came voluntarily. And otherwise hee cannot answer.
32. To the fourth hee saith that the said frigot was in the service of
33. this Commonwealth, and otherwise hee cannot answer saving
34. as aforesaid.
35. To the fifth hee saith that hee cannot answer saving as aforesaid
36. and saving the company paid x s per man for damage of sugars
37. that were leaked out, and the said Cox should have paid accordingly
38. if hee had staid.

50. at the Barbadas namely in or about January last was a
