Transcription

1. this deponent beleeving and observing the sayd Webber to bee unwilling
2. to deliver the sayd ten pipes, which hee beleveeth hee might have done
3. for that four pipes of wine which should have bin brought aboard his
4. this deponents shipp were in like manner XXXX laden aboard an
5. other shipp whereof one XRichard Clarke was master lying the
6. sayde voyage at the Cananries were by the sayd Clarke upon demand
7. delivered to this deponent and laden aboard this said deponents shipp./

8. To the 6th Interrogatorie saving his foregoing deposition to which hee
9. referreth hee answereth negatively to this Interrogatorie./
10. To that last hee saith hee cannot answere knowing nothing nor having
11. heard any thing to the effect Interrogate./.

behalfe of the sayd Sir John Barker the 15th of
May 1656./

one years of thereabouts a wittnes sworn and
examined saith and deposeth as followingly videlicet

26. To the first second and third articles of the sayde allogation hee saith
27. that hee well knoweth and remembreth that hee this deponent and
28. one XXXX Mr Robert Harvie the deponents precontest and the arlate
29. Gyles Travers being all together at the XXX XXXX XX lodgeing of
30. the arlate Robet Barker deceased (who then lay sick of the last sicknes
31. whereof hee dyed) about stateing and perfecting Accounts betwixt the
32. sayde Travers and the sayde Rober Barker hee the sayde Rober Barker
33. among other discourse that passed told this deponent that there was ˹a˺ Cargoe
34. of Tobaccoe shippees for Spaine by this sayde Mr Travers and him the
35. sayde Robert and that hee the sayde Robert had a quarter part therein
36. and was to have XXXX XXX of and in the sayde Cargo which words ˹or words to that like effect˺ hee soe
37. spake in presence and hearing of the sayde Mr harvie and this deponent and
38. alsoe of the sayde Travers who noe way contradicted or denyed the same
39. And further to these articles hee cannot of his certaine knowledge
40. depose not being privie to the lading of the sayde Tobaccoes not
41. seeing or certainly knowing upon which shipp they were laden, but
42. saith hee hath credibly heard and belongeth that the sayde Cargo of Tobbacoe
43. was laden aboard the X arlate shipp the Eve and in her transported
44. to Spaine or other parts beyound the seas and part thereof invested in
45. wynes and fruite and videlicet a hundred fiftie and sixe pipes of wine
46. and one hundred barrells of raysins which wines and raisins as hee
47. hath likwise heard and beleeveth did safely arrive at this port of London
48. in the sayde shipp the Eve, and for the reason aforesayd beleeveth the
49. sayde Robert had a quarter part of the sayde wynes and raysins properly
50. belonging to him his further hee cannot depose. saving his subsequent

52. To the 4th hee saith hee also heard the arlate Rober Barker in his
