Examined upon the same allegation.

John de losa Barona of Segovia in the Realme
of Spaine Marchant, aged 40 yeares or thereabouts
sworne and examined.

To the first article of the said allegation hee saith and deposeth that
hee well knoweth the producent Thomas Sanchez de Urisa and
hath soe donne for theise twelve or thirteene yeares last or thereabouts
and saith that in or about the moneth of October last past hee this
deponent was present at Cadiz in Spaine and did there see the said
producent lade the silver in question into a boate to be caried aboard
the shipp the Saint George arlate lying in the roade of Cadiz to be therein
carried for Ostend, an sawe the said boate goe aboard the
said shipp therewith, and that the producent went alonge therewith
accompanied with Antonio Stephan da Balderas, in which
space this deponent and his precontest John Mexia de Herrera
stood upon the strand and observed the premisses being privie to the said lading
and assisting therein, they being all friends and comming together
from the Indies. And for the particulars of the said silver hee saith
the same was three barres of silver of the first marke in the
margin of the allegation, and foure wedges of silver of the same marke
and two baggs of peeces of eight of the same marke, the one with
foure hundred peeces of eight and the other with 200 and upwards
as in the outside thereof appeared. and alsoe seaventy small peeces
of silver covered with canvas of the second marke. Of all which
hee saith the said producent was and is the sole owner and proprietor
and laded the same for his owne accompt, noe other person having
interest therein: which hee knoweth comming out of the West
Indies in company of the said producent and seeing him bring them
thence with him, having at first only two barrs and the rest
in wedges, peeces of silver and of eight, and at Newe
Cartagena in his way for Spania hee melted soe many peeces
of eight as made the third barr being the least of the
three. And after hee had soe laded them aboard the Saint
George hee came and acquainted this deponent therewith and showed
him the masters receipt for the same; And otherwise hee cannot
depose.

To the second article and schedule annexed showed unto him hee
saith the same was and is a true and originall bill for the said
silver and was and is subscribed with the proper hand of the
said Captaine of the Saint George with whose hand
writing hee this deponent was and is well acquainted, and
the contents thereof were soe had and donne as therein is contained
which hee knoweth for the reasons aforesaid. And othewise hee
cannot depose.

To the third article hee saith and deposeth that the said Thomas
Sanchez was and is a native of Validolid in Spaine, and
subiect of the kinge of Spaine betweene whom and this
Commonwealth there was and is peace and amitie. [?And ?further]
that the said shipp in her course for Ostend was staid by the
shipps of this Commonwealth with the said silver aboard
the said shipp and seeing the said seizure.
