and saith hee was Carpenter of the ''ffree … and saith hee was Carpenter of the ''ffreeman'' the tyme Interrate and saith it<br />

remembreth when the ''Mary'' fell fowle of the ''ffreeman'' in manner predeposed and<br />
hee saith one Appleby a quarter Master of her was at the helme of the<br />
''ffreeman'' when the ''Mary'' came fowle of her as aforesayd And further<br />
hee cannot answere/
To the 2 hee saith hee is not as yet paid his wages for the voyage Interrate<br />
but may receive the same when hee please all but thirty shillings which hee<br />
beleeveth will be stopped out of the same when hee receaveth his wages, the like summe having<br />
bin stopped out of the wages of others of the shipps Company. and saith the same<br />
was stopped out of othes wage, and will be stopped out of his wages hee demandeth<br />
his wages, for tobaccoe which is missing and appeareth by the boatswaines booke<br />
was laded aboard the ''ffreeman'' And further hee cannot answere otherwise than<br />
negatively haveing never heard of any such resolution or declaration as is<br />
interrogate./
To the third hee saith this deponents contests Edward King and Robert holding<br />
and others of the Company of the ''ffreeman'' did call out to the company<br />
of the ''Mary'' in manner predeposed and saith the ''Mary'' was t a good<br />
distance off but were to the leewards soe that they might easily heare what<br />
was sayd unto them, but what answere they made hee knoweth not but well<br />
knowing that they shaped their course with the ''Mary'' in manner predeposed,<br />
although they had tyme sufficient to have stopped her and putt her astayes And further<br />
hee cannot answere saveing hee saith the ''Mary'' by her soe running against the<br />
''ffreeman'' did receave damage and had her mayne mast broken by the board<br />
with the bolspritt of the ''ffreeman'' but the value of the damage hee knoweth not/

saith as followeth videlicet./
To the first second and third articles of the sayd allegation hee saith that the shipp the<br />
''Mary'' was comming up the River of Thames with the benefitt of the tyde of ffludd<br />
and the ''ffreeman'' goeing downe towards Gravesend with a smale gale of wind, and<br />
saith that a little before the damage in controversie happened to the arlate shipp<br />
the ''Mary'' the Company of the ''ffreeman'' (seeing the ''Mary'' make toward them<br />
with the benefitt of fludd) called out to the Company of the ''Mary'' and desyred<br />
them to keepe a loose and to put their shipp astayes and hee this deponent alsoe waved to them with his hatt and spake to them to [?XX XXX] and told them that if<br />
they did not doe soe the shipp ''Mary'' would runne on board the ''ffreeman'' or else<br />
