To the fowerth. 5.th and 6th articles of t … To the fowerth. 5.th and 6th articles of the said Allegation and to the schedule or<br />
bill of ladeing annexed and now shewed unto him hee saith and<br />
deposeth That upon such the ladeing of the said Barratoones<br />
and bag of peeces of eight on bord the said shippe hee this deponent<br />
did at Cadiz signe three severall bills of ladeing for the same all of one and<br />
the same Tenor and date one of which was delivered to this deponent<br />
by the party to whom the said Barratoones and peeces of eight were brought<br />
abord and the other two the said party tooke and carryed away with him ashore<br />
which done the said ship sett saile from Cadiz towards Ostend or<br />
Dunquerke and in her Course thitherwards was mett with and taken by<br />
Captaine [?Coxe] in the ''Phenix Frigot'' in the service of this Commonwealth<br />
and was brought into this Port at which tyme the said Barratoones ad peeces<br />
of eight were on bord her and came to the hands and possession of the<br />
takers thereof. And saith that the bill of ladeing annexed and nowe<br />
showed unto him was and is one of those three originall bills of<br />
ladeing which this deponent soe signed at Cadiz upon the ladeing of the<br />
said plate on board and which hath since that bin sent over land from<br />
Cadiz to fflanders and from thence thither by the said Jaques Van Eycke<br />
to the arlate Mr James Stanier with orders (which this deponent<br />
hath seene) to clayme the said plate and Barratoons for him the<br />
said producents who was and is as this deponent conceaveth and verily beleeveth the<br />
true and only owner thereof And further cannot depose/.
To the 7th and 8th articles hee referreth himselfe to his foregoeing deposition<br />
And otherwise hee cannot depose./.
To the last hee saith his foregoeing deposition is true.
To the Interrogatories. [CENTRE HEADING]
To the first Interrogatorie hee saith that hee came first on bord the said ship<br />
the ''Saint John Evangelist'' at Serdam about 3 or 4 yeares since at which time he<br />
was sent from Ostend to buy and did buy her for the use of the now<br />
Owners thereof. And further cannot depose.
To the second and third Interrogatories hee saith hee doth not knowe the person of<br />
the said Jaques Van Eycke but knoweth the Interrate ffrancisco de<br />
La Seirpe who came with the said Plate and silver on bord which said<br />
de la Serpe (sic) was and is a Spaniard and a subiect of the King of Spaine. And<br />
further saving his foregoeing deposition hee saith he cannot depose.
To the 4th Interrogatorie hee saith that the said Jaques Van Eycke was and<br />
is commonly accompted a fflandrian by birth and a Merchant of<br />
Antwerp. And otherwise saving his foregoeing deposition hee<br />
saith hee cannot depose.
To the 5th Interrogatorie hee saith that the said Barratoons and<br />
plate were laden on bord the said ship in the day tyme at which tyme<br />
his precontest entred the same into his Booke under the markes and<br />
as laden for the accompt predeposed. And further saving his foregoeing<br />
deposition hee saith hee cannot depose.
Toeposition hee saith hee cannot depose.
