Exámined upon an allegation givein in by
Clements on the behalfe of Browning

James Downe of London Marchant living in
Bishopsgate streete at the signe of the Bull
aged 38 yeares or thereabouts sworne and examined
10. To the first article of the said allegation hee saith and deposeth that for theise
11. twenty yeares last past hee this deponent hath well knowne the
12. custome and manner of trade of the English at Cadiz and of the duties
13. paid and payable to the masters and Pursers of the English shipps there
14. hee having for that space frequented that port both as a merchant
15. and as a Purser of shipps, and for fourteene yeeres of that space
16. residing there, and thereby hee well knoweth that it hath bin and
17. is there XX usuall ˹and˺ custome that such masters and ˹or˺ Pursers of any
18. English shipps ˹whereof English men are owners˺ as trade or lain there, being imployed on shore about
19. the owners busines, have bin for all the said time and are allowed during
20. such their imployment on shoare about the shipps businesse as to
21. retaine freight or to let out the shipp to freight or the like a peece
22. of eight by the day XXXXXX and for each day, for his ˹or˺ and their
23. expens and charges on shoare over and above his or their wages
24. contracted for, and hee for his part having bin Purser there in two
25. shipps (whereof English men were owners) was allowed the same and
26. after the same rate, And this custome as he hath bin informed hath
27. bin observed time of out of minde, and is well knowne to and
28. notorious amongst merchants and mariners trading to XXXX that port,
29. And otherwise hee cannot depose.

John Stephens of London Mariner, aged 46 yeeres or
thereabouts sworne and exámined.
38. To the first article of the said allegation hee saith and deposeth that hee
39. this deponent as a person imployed in sea faring affaires and
40. mariner hath for theise twenty yeares last frequented the port of
41. Cadiz in Spaine, and thereby well knoweth that the masters an or
42. Pursers of any shipp (whereof English men are masters ˹owners˺) being
43. imployed in there in the masters and shipps busines have bin from time
44. to time and are by custome and ought to be allowed a peece of eight
45. per diem for each and every day of such their being present in that
46. imployment towards their charges and expenses, over and above their
47. wages, and this deponent both as a master and as a Purser of
48. English shipps hath alwaies and from time to time bin allowed the same
49. with one contradiction. and as this deponent hath heard, this custome
50. hath bin used and observed time out of minde. And otherwise hee
51. cannot depose.
