To the fifth hee cannot answer.

To the last hee saith hee this examinate being servant to Mr Nicholas
Delves living in ffriday streete a correspondent or friend of Mr Bradshaw,
hath by order of his said master paid moneys in this cause to Mr Bradshaws
proctor, being delivered him by his master to that purpose.

Examined upon an allegation made in the acts
of Court the 22th instance on the behalfe
of the said Sandiford.

Edward Tarleton of Liverpoole Mariner, aged 30
yeeres or thereabouts sworne and examined.

To the said allegation hee saith that the producent John Sandiford as lawfull
owner a, and being in the quiet possession of the shipp the Manchester arlate put
and constituted this deponent master of her on the seaven and twentieth day
of July last, at which time this deponent tooke possession of her to the
use of the said producent, who was then owner of her and soe commonly
accounted, and this deponent hath ever since continued master of and bin in
possession of the said vessell in right of the said owner, And saith that about
a moneth since hee this deponent was present at the Nags head taverne
in Cat-Eaton streete London in company of the said Sandiford and of the allegate Mr
Anderson, at which time and place hee saith the said Sandiford as owner aforesaid did let
the said shipp to freight to the said Mr Anderson a merchant of dublin, for a voyage
to be made with her from this port to dublin in Ireland, and contracted with
the said Anderson that teh said shipp should be readie to proceed upon the
said voyage (within three weekes from the time of the said contract) with
such goods as the said Anderson should lade or cause to be laded, at all which
this deponent was present and heard the same, and saith that in persuance of
the said affreightment the said Anderson hath laded aboard the said shipp
about seaven tonnes of goods, and saith that the time for the said shipps
departure upon the said voyage is alreasy lapsed or past, yeelding a reason
of his knowledge as aforesaid.

To the Interrogatories.

To the first Interrogatorie hee saith that about a month before the said Sandiford
went hence for Ireland, namely about a moneth since hee and this deponent being
in a house at debtford where they lodged together and having discourse about
the said shipp the Manchester, the said Sandiford told this deponent and said that
hee was indebted to Mr Bradshaw an hundred and eightie pounds and had set his
hand to a bond for payment, which bond (when hee came afterwards to take notice
of the tenor of it) [?proceeded] as hee said in the nature of a judgement, and least the
said Bradshaw should by vertue thereof lay hold on his said shipp, hee had as
hee said made over the said shipp by bill of sale to Mr Wainwright and
some others
