Transcription

To the 3. hee saith, That the said shipp the Elizabeth in her Course from Lisbone
for England with the goods aforesaid did in or about the moneth of Aprill last
past, (the time hee otherwise remembreth not) come throught the downes, and
being there the weather happened to be very tempesyuous and thick weather, and
so much wind that the Pilot who was aboard her would not, and said hee durst not
undertake to bring her into dover, And this deponent verily beleeveth shee could not
a that time have come in, but would in all likelihood togeather with her lading have perished and
been lost in the sea, for that another English shipp then came from Lisbone and [?being]
in the Roade of dover expressly to deliver her Lading there was by extreamity of weather
forced to beare away from thence for London, this deponent all that while belonging to
and being Gunner of and aboard the said shipp Elizabeth, And further cannot
depose./

To the 4th hee saith That by reason of the said dangerous wind and weather
the said Master and Companie having a just apprehension of the imminent danger
of the said shipp and goods predeposed were delivered to the said Edward and
John Bushell or their order, safe and well conditioned, This deponent being present
at the deliverey of the said goods. And otherwise saving his foregoeing deposition hee
saith hee cannot depose:-/

To the 5th hee saith hee referreth himselfe to the Acts and proceedings of this Court
And further cannot depose, saving hee beleeveth the said producent
by the forbearance or non-payment of the said freight hath suffered dammage to the valew of
20 li and upwards, which hee might in all probability have made good by the
imployment of the said money.

To the Crosse Interrogatories :-/ [CENTRE HEADING]

dt. Smith:-/

To the first hee saith hee cometh to be a Witnesse in this Cause at the request
of John Salmon the producent, and can write and reade, and hath received all his
wages for the Voiage interrate, and saith hee this rendent is bound upon another Voiage with
the said Salmon, And otherwise, saving his foregoeing deposition, negatively./

To the second hee saith hee knoweth not who was to have received the said sugars
at or neere dover, and saith the said shipp did not nor could in safety stay in the
downes after her coming thither, nor was there any person aboard her there to demannd
the said sugars, And further hee knoweth not nor can hee depose./

To the third hee saith, That the bills or bill of lading by him predeposed was in English
and saith the goods predeposed were mentioned therein to be delivered upon the freight
predeposed. And further remembreth not at present./

To the 4th hee saith hee did not sett downe in writing where the wind blewe the
time interrate but saith hee remembreth it was at South East right to the English shoare nor were any goods delivered out of her either in the downes or
at dover, and this rendent is in Conscience convinced that the interrate Salmon
could not without very great and imminent danger of the losse of his said shipp and her
then lading, have delivered or attempted the delivery of the goods interrate at
dover or in the downes./

To the 5th hee saith, That this rendent being present at the delivery of the
sugars interrate here at London did not observe that any of them were
damnified. And further cannot depose./
