Transcription

To the first and second articles of the sayd allegation hee saith that
in the yeare 1652 and moneths therein concurring the arlate Richard Thompson
and John Solomon (both of which this deponent well knoweth and is
acquainted with) were commonly accompted and reputed the true
lawfull iynt and only Owners and Proprietors in equall parts of the arlate
shipp the Love of London her tackle apparrell and furniture and of whatsoever
freight or other profit should or did arise or growe due by the imployment of the sayd
shipp and this deponent beleeveth them soe to be for that in the sayd yeare
1652 and this deponent beleeveth them soe to be for that in the sayd yeare
1652 (there being some difference betweene the sayd Thompson and Solomon
about Accompts for freight and other things by reason of their ioynt imployment
of the sayd shipp) this deponent and one Mr Beake were by the sayd parties
chosen to arbitrate the sayd difference (but this deponent and the sayd Mr Beake never mett to make any aarbitration therein) as alsoe for that the sayd Thompson
and Solomon as ioynt partners in the sayd vessell or shipp made two severall
voyages that yeare 1652 to dunkirke or Ostend and brought home each
voyage a ladeing of [?linge], which they both of them sold to this deponent
and did ioyntly as partners receive the money due for the same of this deponent
according to contract by them made And further to these articles hee
cannot depose./

To the last hee saith his foregoeing deposition is true/

Mariner late Master of the said shipp the Charity
aged 34. yeares or thereabouts a Wittnesse sworne
and examined saith as followeth videlicet:-

To the first Article of the said Allegation hee saith and deposeth that in the
yeares 1651. and 1652. arlate and in some of the moneths therein concurring
the arlate Richard Rice James Cole and Companie were the true and
lawfull Owners and Proprietors of the shipp the Charity arlate and of her
tackle apparrell and furniture, and for and as such Owners the said
Rice, Cole, and Companie were generally knowne and esteemed, The
premisses hee well knoweth for that hee this deponent was and is the
arlate Robert harrigate who in the time predeposed was Master
of the said shipp for and on the behalfe of the said Oiwners and for that this deponent,
having formerly bought the said shipp of and from the Commission for Prize
goods at Newcastle did afterwards sell sewerall shares thereof to the said
Rice Cole and Companie reserving oney 1/16 part thereof to this
deponent And further cannot depose:-/

To the second hee saith, That the said Rice Cole and Companie did
in the yeare 1652: in or about the moneth of September lett the said
