1. The fifth of ˹October˺ 1657.

6. Commander of the shipp the Successe
7. in the immediate service of this Commonwealth
8. sworne and exámined as aforesaid saith
9. and deposeth as followeth.
10. To the first Interrogatorie hee saith that there were certaine
11. tobaccoes namely about thirtie thousand weight of tobaccoes
12. (as hee supposeth the quantitie to be) laden aboard the said shipp the
13. Successe (whereof this exáminate was Commander) at Jamaica
14. in or about the middle of Aprill last, to be brought to this
15. port of London. And saith that hee this deponent was at sea
16. when the said tobaccoes were soe brought to Jamaica, but upon
17. his retourne ˹thether˺, hee found them there landed, and there understand that
18. the said tobaccoes were brought thither in a Spanish shipp, and
19. came from a port in the Island of Cuba under subiection of the
20. king of Spaine, and were belonging to Spaniards. And saith
21. that about a day or two after the putting the said tobaccoes aboard
22. the said shipp the Successe, this deponent set saile therewith
23. from Jamaica, and arived in this port with the saje about
24. the beginning of August last, this deponent being then
25. commander of the said vessell and ariving here in her.
26. To the second, Interrogatorie ˹hee saith˺ that shortly after the arivall if
27. the said shipp in this port, the interrogated Thomas Cowell
28. came aboard her, and saying that hee had a Commission
29. to make seizure of the goods of the king of Spaine or his subiects
30. (or words to that effect) did make seizure of the said parcell
31. of tobaccoes, soe brought from Jamaica on the said shipp the
32. Successe whereof this deponent was commander, and was sthen
33. present aboard, but the said Cowell did not then show his said
34. Commission. And otherwise hee cannot depose.

45. or thereabouts and five thousand and odd Manucoes of tobaccoe
46. brought to this port of London in the shipp the Successe (whereof
47. his precontest Zachary Browne was comander) ariving in this
48. port from Jamaica in or about the beginning of August last, upom
