Examined upon the said Allegation.

Peter Matthewes of London Merchant aged 37. yeares
or thereabouts a Wittnes sworne and examined deposeth as
followeth videlicet/

To the first article of the said Allegation hee saith, That hee this deponent hath by
credible relation heard, and by letters of advise, which hee hath seene and perused
hath observed that the arlate Peter de Cock and Baldwin Matthewes did in
the yeare 1653. arlate cause to bee laden by their factors or agents residing at
Cadiz in And aboard the shipp the Saint John Baptist arlate (John de [?XXX GUTTER]
Master) seaven hundred and fiftie peeces of 8/8. to be transported in the same
shipp from Cadiz aforesaid to Ostend in ffalanders upon the adventure and
for the proper accompt of the said de Cock and Matthewes, who as this deponent
upon the grounds predeposed firmely beleeveth were are and ought to bee the
true and Lawfull Owners thereof. And further to this article hee cannot depose

To the second hee saith, That the arlate Peter de Cock was and is this
deponents Cousin, and a native, as hee beleeveth of the Citie of Gant in
fflanders where hee hath by and of this deponents knowledge resided and inhabited
for about 12. yeares last past, and was and is a Subject of the king of
Spaine, betwixt whom and thjis Commonwealth is amity and friendshipp
And saith that the arlate Baldwin Matthewes, who is this deponents
owne brother, was and is an Englishman borne and a Subject of this
Commonwealth and well affected to the Gouvernment thereof, and for the
reasons herein expressed. And further cannot depose, saving that this deponent
for all the time predeposed hath held and still doeth hold correspondence
in trade with the said Peter de Cock,

To the third hee saith, That it is publique and notorious That the said
shipp the Saint John Baptist was in her Course from Cadiz towards dunquirke
mett withall and surprized by some shipps of this Commonwealth
And beleeveth the said seaven hundred and fiftie peeces of 8/8 now
Claymed by the producents in this Cause were at the time of the
said surprizall in and aboard the said shipp, and came to the hands
and power and possession of the seizors thereof. And further hee cannot
depose./

To the 4th article and schedule or bill of lading therein mentioned as [?XXXX GUTTER]
in this Court, and now shewne unto and perused by him this examinate hee
saith and deposeth, That hee this deponent by long correspondence with
ffrancis de La Sierpe mentioned in the said bill of ladeing is fully convinced
and assured in Conscience, That the said bill of ladeing was and is
filled up with the proper hand-writing of the said francis de La Sierpe
and that the Contents thereof were and are true and reall, this
deponent also saith that hee hath severall times seene and observed
