Transcription

of a voyage to Newcastle, which in all probability shee might in that time
have performed, and that the Owners are thereby damnified to the cleare valew, as
hee verily beleeveth of 60 li sterling or thereabouts. a shipp of that burthen as the Mary
is upon such a Voyage in the winter, being very able to cleare so much.
All which hee deposeth upon the reasons aforesaid, And further cannot depose./

To the 4th hee referreth himselfe to the Acts and proceedings of this Court And
further cannot depose./

To the last hee saith his foregoeing deposition is true./

To the Interrogatories./ [CENTRE HEADING]

To the first hee saith hee cometh to wittnesse the trueth of his knowledge in the
Cause in question by the procurement of Robert Yaxley Master of the said shipp
Mary, and was Boateswaine of and aboard upon the decke of the said shipp
together with the said master and his Contests and rest of the said shipps Company
when the dammage in question was done, which was in the forenoone about .10.
or 12. of the Clock. And further cannot depose./

To the 2d Interrogatorie hee saith, That the masts of the said shipp Mary so spoyled as
hee hath predeposed were not new, but very strong and serviceable as could be
required for such a shipp, and saith the standing rigging was all new, and most part of
the running rigging, and that all the tackle and furniture spoyled and perished
by the disaster aforesaid was very firme and sufficient, And saith that such as
the said tackle and furniture as can with some expense be rendred any way usefull
are not in this rendents estimation worth above ten or twelve pounds sterling
And doeth now remaine aboard the said shipp the Mary And further hee
cannot answer./

Robert Lillicrep of Wapping in the parrish of
Stepney and Countie of Middlesex mariner one of the Companie
of the said Vessell the Mary; aged 28. yeares or thereabouts
a Wittnes sworne and examined./

To the first article of the said Allegation hee saith hee cannot depose, saving that hee
hath credibly heard tha the arlate Robert Yaxley and others of Alborough
in the County of Suffolke were and are the true and lawfull Owners of the
arlate shipp the Mary and of her tackle and furniture, and so generally accompted

To the second hee saith and deposeth, That upon ffriday the 26th day of October
last past the said shipp the Mary being in her Course from Newcastle with a
ladeing of Coales, bound for his Port of London, and coming up the River of
Thames in Gallions reach, the Master and Companie thereof espied the shipp
the ffreeman John Whitty Master, coming downe the said River in the reach
aforesaid with a faire gale afore the same the wind then at West Southwest and having
the full liberty of the Channell to passed by the said shipp Mary with
as much convenience as could be desired, yet the said shipp the freeman bearing
directly upon the shipp Mary the Master and Company thereof waved and
called to them of the freeman to keepe a sterne, but the premisses notwithstanding
the said Whitty and Companie violently and wilfully rann aboard the
