ITEM whereas I have a Certaine Coppyhold tenement and twelve Acres of Land Customary in the Hamlett of Milton in the Parish of Prittlewell in the County of Essex which I have not surrendered to the use of my will but take the Custome of the mannor of Prittlewell of which the same tenement and Lands are holden to bee that my wife is intituled to a moyetie thereof dureing her life and my mind being that she nevertheless shall enjoy the whole thereof dureing her life now therefore my will and mind is that in case my next heire according to the Custome of the said mannor of prittlewell that shall enjoy or be intitled to the said Coppyhold tenement and Land shall not upon my said wifes request make and confirme to her a good and legall estate of and in the whole thereof for and dureing her naturall life then and in such case I give to my said wife the sume of fifty pounds out of what shall or may be comeing to such heire by  this my will over and above the said Moyetie coming to her by the custome of the said mannor and I will that in such case she dafaulke and abate the same fifty pounds to her owne use accordingly anything in the my will conteyned to the contrary notwithstanding

Copyhold or customary Lands I have surrendered to the use of my will

ITEM whereas I have a Certaine Coppyhold tenement and twelve Acres of Land Customary in the Hamlett of Milton in the Parish of Prittlewell in the County of Essex which I have not surrendered to the use of my will but take the Custome of the mannor of Prittlewell of which the same tenement and Lands are holden to bee that my wife is intituled to a moyetie thereof dureing her life and my mind being that she nevertheless shall enjoy the whole thereof dureing her life now therefore my will and mind is that in case my next heire according to the Custome of the said mannor of prittlewell that shall enjoy or be intitled to the said Coppyhold tenement and Land shall not upon my said wifes request make and confirme to her a good and legall estate of and in the whole thereof for and dureing her naturall life then and in such case I give to my said wife the sume of fifty pounds out of what shall or may be comeing to such heire by this my will over and above the said Moyetie coming to her by the custome of the said mannor and I will that in such case she dafaulke and abate the same fifty pounds to her owne use accordingly anything in the my will conteyned to the contrary notwithstanding

ITEM I give and bequeath to the severall persons herein after named the several gifts and legacies herein after menconned in good and lawfull mony of England Vizt to my brother William Moyer the summe of fifteene hundred pounds and to my sister Hannah his wife the summe of fifty pounds and to his three Children James Hannah and Elizabeth two hundred pounds a peece to bee paid to their said ffather for their use and his receipt to bee a sufficient discharge to my Executrix for the same

ITEM I give to my loveing kinsman the said Samuell Moyer sonne of my said brother Samuell Moyer deced the summe of one thousand poundes to the four children of the said Samuell Moyer my Nephew Vizt Roberta, Mary, Elizabeth and Lawrence, two hundred pounds a peece to bee padi to their said ffather for their use and his receipt to bee a sufficient discharge to my executrix for the same

ITEM I give and bequeath to the three Children of my Nephew Lawrence Moyer Vizt Martha Lidya and Benjamin two hundred pounds a peece alsoe to bee paid to their said ffather for theire use and his receipt for the same to bee a sufficient discharge to my Executrix

ITEM I give to my neece Lydia ?Ruffin one hundred pounds all which Legacies or Summe of mony before herein bequeathed I will to bee paid within one yeare next after my decease

ITEM I give and bequeath to the five children of the said Lidya fifty pounds a peece to bee paid them respectively at the respective ages of one and twenty years of the sonnes and age of one and twenty yeares or dayes of marriage of the daughters which shall first and next happen and I wil that Interest shall be allowed by me Executrix for the same after the rate of five pounds per Cent p Annum in the meanetime to bee paid halfe yearly to their Mother for their maintenance and preferment and her receipt for the same Interest from time to time shall bee a good and sufficient discharge to my Executrix and in case any of the said five children shalll depart this life before their respective Legacies shall become due and payable as aforesaid then the principall summe hereby given to him or her of them so dying shall goe to the Survivours and Survivour of them

ITEM I give to my neece Rebecca Thornburgh the summe of hundred pounds to bee paid her within one yeare next after my decease and to her two daughters fifty pounds a peece to bee paid to them respectively and to the Survivour of them at their respective age of one and twenty yeares or day of marriage which shall first happen and I will that interest shall be allowed by my Executrix for the same in the meane time after the rate of five pounds p Cent p Annum to bee paid halfe yearly to their said Mother for their maintenance and preferment

ITEM I give and bequeath unto my sonne in law Nicholas Charlton the summe of fower hundred pounds to his wife twenty pounds to my brother in law Thomas Alvey thirty pounds to my couisn Elizabeth Baker the elder twenty pounds

of one hundred pounds to bee disposed of to such poor objects of piety and Charity as my Executrix shall thinke fitt to M:r John Stripe Minister of this parish of Lowlayton tenn pounds to my loveing friend Gerard ?Vaher tenn pounds and to his wife for a mourning ring twenty shillings to my Godsonne Lawrence Batten for a peece of plate tenn pounds all which legacies to bee paid within twelve Moneths next after my decease

ITEM I give to my brother Thomas Johnson and to his wife ten pounds a peece for mourning for each of them

ITEM I give to Robert Barker sonne of Mathew Barker to bee disposed of in placeing him out as my Executrix shall thinke fitt tenne pounds to the poore of the parish of Lee in the County of Essex where I was borne twenty pounds to be disposed of by my Cousin Samuell Moyer as hee shall thinke fitt to the poore of the parish of Lowlawton (sic) twenty pounds to bee disposed of as my Executrix shall see occasion

ITEM I give unto my wife twenty five pounds to bee disposed to and amongst such servants as she shall thincke fitt that shall bee dwelling with mee at the time of my decease

ITEM I give unto my very loveing kinsman Captain Richard Goodlad[1] the Diamond Ring which I weare upon my finger and to his wife twenty shillings for a mourning ring

ITEM I give and bequeath into my said deare and loveing wife ffrancis Moyer all my Household goods Jewells and plate as a particular token of my love to her excepting the furniture of the three Roomes one over another in the newe end of my dwelling house which I will after my wife's decease to continue to the house and my best Persia Carpett and Grogram Yarne Carpett I will to my brother William Moyer after her decease the rest and residue of my goods and Chattells Rights Vreditts bills bonds specialities monyes Jewells plate householdstuffe and personall estate wheresoever and whatsoever after my Just debts Legacies and funeralls first paid satisfyed and discharged I give will and bequeath into my said deare and loveing wife ffrances Moyer whome I make constitute and appoint sole Executrix of this my last will and Testament and my will and mind is expressely declared that if any Losse or Casualty Losses or Casualtyes shall come to my estate or any parte thereof before the same shall bee gotten in or received by my Executrix that then and in such case the severall and respective Legatees before herein menconned shall ratably and proporconably beare and abate the same losse or losses out of their respective Legacies and my wife to beare noe parte thereof and I appoint my brother William Moyer and my Cousins Samuell Moyer Overseers of this my will desireing them to assist my Executrix in the Execution thereof

IN WITNESSE whereof I the said Lawrence Moyer the Testator have to this my last will and testament conteyned in fower sheetes of paper besides this present sheete put my hand and seale dated the day and yeare first before written

WHEREAS a consdierable part of my personall estate consists in East India accons or a stocke in the East India Company which Actions or Stocke I value into my personall estate at the summe of five thousand two hundred and fifty pounds sterling in the whole now my will and mind expressly is and is hereby declared to bee that in case the said Stock shall sinke or falle shorte of the said Summe I value it at as aforesaid shall bee borne and susteyned rateably and proportionably by the severall legatees in my will named out of the respectove Legacies to them respectovely given in or by my will and that my wife and executrix ffrances Moyer shall and may abate and defaulke the same out of their respectove legacies accordingly and that she shall beare noe parte of the said losse or falling shprte and further my will and mind is that whereas in and by my said will I did will the furniture of the three roomes one over another in the new end of my dwelling house to continue to the house now I doe hereby give and bequeath the said furniture to my deare and loveing wife the said ffrances Moyer to her owne use any matter clause or thing in the said will contained to the Contrary hereof in any wise notwithstanding and in all other points and things my said last will to stand and remaine in full force witnesse my hand and seae this fowerteenth day of march Anno Dmo one thousand six hundred eighty four and in the first yeare of the raigne of our Soveraigne Lord James the second by the grace of God of England x:r King xr

"[December 11, 1661] Order is given for certain goods to be delivered to Richard Goodlad on payment of a fine of 35/., he to be returned 25/. of that sum for his good services in helping to save the treasure from the wreck of the Smyrna Merchant.[2]

"[April 9, 1662] Some calicoes returned in the Katherine to be delivered to George Willoughby on payment of one-third of the fine ; and some returned in the Blackmore to be delivered free to Richard Goodlad, late purser in the Smyrna Merchant."[3]
