her, by reason that shee the Imployment was bilged upon the Anchor
of an other shipp which laye not farr from her at Anchor without a boy)
Whereupon this deponent refused to take the remaynder of the Coales soe
bought by him as aforesayd at the rate of 23 li - 10 s a score, for that they
were soe much damnified that they were not merchantable. soe that the sayd
Bayly being necessitated to lighten his sayd shipp was forced to come
to a new agreement with this deponent and take for the remaynder of
the sayd Coales bought by this deponent (and undeliveered before the damage
in question happened) the summe of twenty two pounds tenn shillings
sterling and noe more, and this deponent did pay him the sayd Bayly after
the rate of 23 li - 10 s for soe many of the sayd Coles as were delivered before
the sayd damage happened and after the rate of 22 li - 10 s sterling and noe
more for the remaynder aforesayd which were delivered after the sayd
damage happened, And hee further saith that hee heard his Contest
Richard Davies and a servant of Maior generall Browne a woodmonger
of London saye, that they had alsoe bought of the sayd Bayly before the
sayd damage receaved parte of the lading of Coales then a board the
Imployment, and agreed to pay him the rate of 23 li - 10 s sterling a score
for them and had receaved some of them drye and well conditioned before the sayd
damage happened, and hee heard the sayd davies saye that hee paid the
sayd Bayly after the rate of 23 li - 10 s sterling a score for all the Coales
hee receaved before the sayd damage, happened, And knoweth and sawe the sayd Maior
generall Brownes man (before the dammage hapened) lade some
of the coalses by him bought and carrie them away in a lighter drie and well
conditioned, for which (as the sayd Brownes man told this deponent) hee
paid the sayd Bayly after the rate of 23 li - 10 s a score, And further
to this article hee cannot depose, for that hee knoweth not whether the
sayd Brownes man fetched the remaynder of the Coles by him bought
after they were damnified by meanes of the damage in question/

To the 2 and third Interrogatories hee cannot answere, hee this deponent takeing
noe notice what shipps lay neere the Imployment but only mindeing
the lading of the Coales by him bought./

To the 4th hee cannot answere not knowing what is usuall in such
case as is Interrate./

To the 5th hee saith it concerneth him not to answere thereto for that
hee hath not deposed to the effect Interrate./

To the 6th hee cannot answere knowing nothing nor having heard ought
of the matter Interrate./
