same knoweth that the ''Consent'' and ''Ph … same knoweth that the ''Consent'' and ''Phenix'' did from Thursday to Satterday at<br />
night winde cleere one of an other every tyde and receaved noe dammage one<br />
from the other till the ''Consents'' new mooreing<br />
saving that on the Sunday the ''Consent'' lay cross the ''Phenix''<br />
hawse as aforesayd. And further hee cannot depose saving his foregoeing<br />
deposition./
To the 6th hee saith that hee this deponent verily beleeveth that in case the<br />
''Phenix'' Anchors did at any tyme lye Easterly and Westerly the same was<br />
occasioned by the ''Consents'' coming crosse the ''Phenix'' hawse and thereby bringing<br />
home her Anchors and thereby causeing them to lye watershott and<br />
contrary to what (as hee knoweth they were first layd) And further<br />
hee cannot depose/
To the 7th and 8th hee saith hee hath credibly heard amongst seamen<br />
and by reason hee hath used to goe to sea and bin conversant aboard<br />
shipps knoweth that it is usuall Custome that when shipps ride<br />
at Anchor in the River of Thames they ought to keepe men aboard<br />
to vew amd heare for the prevention of danger that for want thereof<br />
may ensue And further hee cannot depose not knowing whether the<br />
''Consent'' had any body aboard her to looke to her but beleeveth if<br />
shee had had men aboard her to vew and heare the dammage in question<br />
might have bin prevented And further to these articles hee cannot depose/
To the 9th hee saith hee did observe and well knoweth that the ''Consent'' the<br />
tyme arlate was an old shipp and had ridd up and downe in the River of<br />
Thames severall months before the dammage in question happened hee<br />
this deponent liveing neere the River and observing her soe to have done<br />
and saith hee hath heard shee was then out of imployment by reason of some<br />
difference betweene the Master ffreighters and Owners of her And further<br />
to this article hee cannot depose/
To the 10th hee saith that the dammage in question happened on wapping<br />
side of the River of Thames and where shee might have had very convenient<br />
places neere hand to be hawled unto and that the arlate Swier caused her<br />
to be hawled crosse the Thames on Rederiff side neere the Mill there<br />
which was a few more remott and inconvenient place to hawle her to and<br />
such a place as a farr stronger shipp than the ''Consent'' (who was old)<br />
could not lye in without receaveing dammage thereby And hee verily beleeveth<br />
that the ''Consent'' by being hawled soe farr and to soe inconvenient a place<br />
did receave three tymes more dammage than shee did by setting upon<br />
the ''Phenix'' Anchor And further hee cannot depose/
To the Interrogatories/
To the first Interrogatorie hee saith hee cometh to testifie the truth of his knowledge<br />
in this Cause at request of Church one of the producents and hath receaved <br />
nothing nor expecteth or is promised any thing for his testimony And to the<br />
rest of the Interrogatorie hee answereth negatively./
To the 2 Interrogatorie hee saith saving his foregoeing deposition hee cannot<br />
more certainly answere at present but saith as hee remembreth the<br />
dammage in question happened in the yeare 1657./
To the 3 Interrogatorie hee saith that the Anchor of the ''Phenix'' by which the dammage<br />
