beleeveth noe shipp ought to ride at Ancho … beleeveth noe shipp ought to ride at Anchor in the River of Thames without<br />
a boy at their Anchor and that those that transgresse in that kinde are lyable to<br />
make good what damage happeneth to any other shipp for want of the same and<br />
are fineable alsoe for the same./
To the 4th hee cannot depose
To the 5th hee referreth him selfe to the rules and orders arlate and further<br />
cannot depose/
To the 6th hee cannot depose
To the 7th and 8th hee saith the arlate shipp the ''Imployment'' within the tyme arlate<br />
moored neere the middle of the Thames neere Execution dock and in<br />
a Convenient place there and such a place as was in all probability and outward<br />
appearance a safe place to moore in, where shee laye safe moored of this<br />
deponents sight and knowledge at the least fower or five tydes before the samage<br />
in question happened this hee deposeth for that hee liveth neere the place where<br />
shee was soe moored and sawe her dayly and was alsoe one of the sixteene men<br />
that was hyred by the sayd Bayly to unlade her then ladeing of coles<br />
and did helpe to unlade about forty or fifty chalder of Coales from on board<br />
her but the next day before the damage in question happened and<br />
observed that they were all [?XXX] drye and well conditioned And further to these<br />
articles hee cannot depose/
To the 9th 10th 11th 12th 13th 14th 15th and 16th articles of the sayd<br />
libell hee saith that for that hee was imployed as aforesayd to helpe<br />
to unlade the sayd shipp the ''Imployment'' and wrought upon her as aforesayd hee well<br />
knoweth before the damage in question happened the sayd shipp was stanch<br />
and tight, And saith the sayd Bayly did at first before the sayd<br />
damage happened agree with this deponent and his contest Richard Wincles<br />
and fowerteene other Coaleheavers at the rate of twelve shillings a man<br />
to unlade the sayd shipps ladeing of Coles and this deponent and the<br />
rest of the sayd Coleheavers according to the sayd bargaine did fall to<br />
worke and unlade about forty or fifty chalder of Coales out of the sayd shipp<br />
the day next before the damage in question happened (which was in the moneth<br />
of October last) and intended to proceede on with the delivery of the rest<br />
at the same rate, but saith the next day after they had soe unladed the sayd<br />
forty or fifty chalder of Coales as this deponent and the rest of the sayd Coale<br />
heavers were goeing towards the sayd shipp to worke the sayd John Bayly<br />
mett them and told them his sayd shipp was about suncke and desired<br />
them for Gods sake to make all the hast on board they could and to fall to worke<br />
to lighten her and told them hee would goe to Billingsgate and hyre men to<br />
come aboard and pumpe and bayle her thereby to keepe her above water, whereupon<br />
this deponent and the rest of the sayd Coleheavers made hast aboard but<br />
at their comming on board found her soe deepe in water in the hold that<br />
they thought fitt not to fall to worke till the sayd Bayly returned on<br />
