Transcription towards Gravesend and the arlate shipp thetowards Gravesend and the arlate shipp the''Mary'' was then coming up towards<br /> London with the benefitt of the tyde of fludd And hee saith that before the damage<br /> in question happened and while the ''Mary'' arlate was to the Northward at a good distance<br /> from the ''ffreeman'' but within such a distance as the Company of the ''Mary''<br /> might well heare and understand what was sayd to them some of the Company of the ''ffreeman''<br /> called out to the Company of the ''Mary'' arlate and willed them to put their<br /> shipp a stayes and told them if they did not soe doe the same would runne fowle<br /> of the ''ffreeman'', or put her ashoare or to that effect notwithstanding the sayd<br /> shipp ''Maryes'' Company though they might then very easily have brought their shipp<br /> a stayes did on the contrarrie beare their mayne topsyle on the back stayes and<br /> put their helme a weather and kept their foresayle full by which course and meanes they<br /> runne a thwart the ''ffreemans'' hawse, which they did wilfully (as this deponent<br /> beleeveth for that they might if they had pleased have avoided tunning fowle of<br /> the ''ffreeman'' by putting their shipp a stayes, or by steereing her to the<br /> Northward shee being but a smale shipp which might have shoared without any<br /> danger, whereas the ''ffreeman'' was a great vessell of above fower hundred tonnes<br /> and drew above sixteene foote water and could not goe neere the shoare without great danger and hazard of the losse of her and her ladeing And this deponent<br /> verily beleeveth and is perswaded in his conscience that what hurt or damage<br /> is happened meerely through the wilfullnes and fault of the Master and Company<br /> of the ''Mary'' and not by any fault in the Master and Company of the ''ffreeman''<br /> the premisses hee deposeth being an eye witnes and one of the Company and on board the ''ffreeman'' And further to these articles hee cannot depose saving hee saith the ''ffreeman'' had<br /> in her the tyme arlate goods to a very considerable value./ To the 4th hee saith hee knoweth not of any Roapes of the ''Mary'' cutt by the Company<br /> of the ''ffreeman'' but saith if any were it was soe done upon necessitie and for the<br /> preservation of the ''ffreeman'' and her ladeing from being runne on shoare by the ''Mary''<br /> And further hee cannot depose To the last hee saith saving his foregoeing deposition to which hee referreth<br /> hee cannot depose/ To the Interrogatories/ [CENTRE HEADING] To the first Interrogatorie hee saith hee cometh to testifie of his knowledge in the<br /> cause being requested soe to doe by John Whitty Commander of the ''ffreeman'' and<br /> saith hee was Quartermaster of the ''ffreeman'' the tyme Interrogate and saith the ''Mary''<br /> runne fowle of the ''ffreeman'' in manner predeposed in the forenoone and when the<br /> tyde was about halfe fludd and better And further hee cannot answere/ To the 2 hee saith hee hath receaved all his wages for the voyage Interrogate save 30 ''s'' which<br /> hee saith is stopped out of the same and the like out of the wages of others of the sayd<br /> ''ffreemans'' Company for tobaccoes which is mentioned in the pursers and boatswaines<br /> booke to be laded in Virginia aboard the sayd shipp and was not found aboard her<br /> at her unladeing here in London And otherwise hee cannot answere having<br /> heard nothing touching any such resolution or declaration as is Interrogate/ To the third hee saith that hee this deponent and Peter Wittie and this deponents contest<br /> George Pu[?tt] Edward Kinge and one John dale and others of the Company of the<br /> ''ffreeman'' did call out to the Company of the ''Mary'' in manner predeposed (but saith<br /> hee heard not any answere made by the Company of the ''Mary'' but observed they still kept on their course And saith the boltspritt<br /> of the ''ffreeman'' by the meanes predeposed did breake downe the mayne mast and<br /> spoile some of the rigging of the ''Mary'' but to what value hee knoweth not And<br /> further saving his foregoeing deposition hee cannot depose./ Repeated before doctor Godolphin Robert holding [SIGNATURE, RH SIDE]lphin Robert holding [SIGNATURE, RH SIDE]  +
