person or persons since his death did ever pay or
satisfy unto the said Middleton any more then a
hundred seaventy nine pounds and five shillinges
of the forseaid somme of two hundred and forty
pounds agreed by him to be paid for the said
sixteenth part of the said shipp and of her tackle and
furniture And otherwise they nor any of them doe
not nor doth beleeve the said pretended position
to be true in any part thereof.

To the third position of the said pretended allegation
they and every of them answeare and accept the
contents thereof soe farr forth as they make for
them, and beleeve that the arlate Allen hath
appeared as Proctor in this cause for the arlate
Edward Arlabeere Thomas Middleton and
company, and that the company of the said
Arlabeere and Middleton were in and by all
the time of the voyage, in this cause libellate,
the persons following, And that the said persons
were for and during all the time arlate the
respective owners and Proprietors of the severall
and respective partes of the shipp arlate and
of her tackle and furniture hereafter expressed
videlicet Thomas humble owner of one 16th
and one 32th part
